Need help with Pokemon Black and White Mystery gift?

My Nintendo DS Lite is old, and it screwed up my data so I had to re- start, however, I want to receive the liberty p thing to get Victini so I try to get it from my brother because we are in each others friend roster, so when I try to get through infrared it tells me to put them near range of each other then to press "A" so I do then it just stays there searching and does not find anything, even though he has it I can't receive it why is that?
