My mortgage broker didn't submit all the important doents to avoid subprime..can they be sued?

We worked for 4 months with our mortgage broker-submitted paystubs, w4's, and had excellent credit. But towards the end didn't use the lease letter that was requested and was advised not to contact the government for a first time homebuyers help because it would delay the process. We could've gotten a 30 year traditional mortgage but his refusal to submit all the doents telling me that it was no longer necessary caused us to go sub-prime.
